Privacy notice and legal information.
How ClystCore Ltd, trading as Baker Accordia, collects and uses personal information: through this website, when we contact professionals about our services, and in the course of an instruction.
Who we are
This website is operated by ClystCore Ltd, trading as Baker Accordia. ClystCore Ltd is registered in England and Wales, Company No. 14330277, with its registered office at Queensgate House, 48 Queen Street, Exeter EX4 3SR. ClystCore Ltd is the controller of the personal information described in this notice. We are not required to appoint a data protection officer; Christopher Baker, Director, is responsible for data protection. Contact us about privacy at enquiries@bakeraccordia.co.uk or by post at the registered office.
Information we collect
- Enquiries. When you use the enquiry form, email or telephone us, we collect what you give us: your name, organisation, job title, contact details, the names of the parties and project for conflict checking, the outline of your enquiry, and any voicemail you leave.
- Professional contacts. For people we may contact about our services, typically solicitors, barristers and other professionals working on construction and property disputes, we hold business contact details: name, job title, firm or organisation, business email address, business telephone number and office address, together with a record of our contact with you and any request not to be contacted.
- Instructions. In the course of an instruction we receive the documents and information needed to carry out the work. This may include personal data about parties, witnesses and other individuals and, where relevant to the dispute, information about health or alleged offences.
- Billing. Names, addresses and payment details needed to invoice and keep accounts.
Where it comes from
Most information comes directly from you. Professional contact details may also come from publicly available sources: your firm's website, the Solicitors Regulation Authority and Law Society registers, and published legal directories such as The Legal 500 and Chambers and Partners. Information in an instruction comes from the instructing party, other parties, their advisers, courts and tribunals, and our own inspections.
How we use it and why
- Responding to enquiries and checking conflicts. Lawful basis: our legitimate interests in responding to enquiries and avoiding conflicts of interest, and taking steps at your request before entering into a contract.
- Carrying out instructions. Lawful basis: performance of our contract with the client, our legal and professional obligations (including duties to courts and tribunals and to RICS), and our legitimate interests in providing expert and advisory services. Where an instruction involves special category data or criminal offence data, we process it only as necessary for establishing, exercising or defending legal claims, as permitted by Article 9(2)(f) UK GDPR and Schedule 1 to the Data Protection Act 2018.
- Telling professionals about our services. Lawful basis: our legitimate interests in introducing our services to firms and professionals likely to need them. We have balanced this against your interests: we use business contact details only, send occasional and relevant messages, and stop as soon as you ask. See below.
- Accounts, insurance and regulation. Lawful basis: legal obligations (including tax and accounting records) and our legitimate interests in managing our business, professional indemnity insurance, complaints and regulatory compliance.
You do not have to give us information, but without it we may not be able to respond to an enquiry or accept an instruction. We do not make decisions about you by automated means, including profiling.
Business emails and opting out
We may send an occasional email to firms and professionals about our expert witness, dispute and ADR services, where your firm advertises work in construction or property disputes. We send these emails only to companies, limited liability partnerships and other corporate bodies, as permitted by the Privacy and Electronic Communications Regulations 2003, and not to sole practitioners or unincorporated partnerships unless they have agreed to receive them. Every email identifies us and tells you how to opt out.
You have an absolute right to object to direct marketing. To stop receiving emails, reply "unsubscribe" or email enquiries@bakeraccordia.co.uk. We will remove your details from our contact list promptly and add them to a short suppression list so that we do not contact you again.
Sharing and processors
We do not sell personal information. We share it only as needed for an instruction (for example with instructing solicitors, other parties where the role requires, other experts, courts and tribunals), with our professional advisers and insurers, with RICS where required, and where the law requires. The following providers process data on our instructions under written terms: Microsoft Ireland Operations Ltd (email and document storage, Microsoft 365), Formspree, Inc. (enquiry form delivery), Vercel Inc. (website hosting), Cloudflare, Inc. (domain, DNS, security and website statistics), Xero (UK) Ltd (accounting and invoicing) and our telephone service provider (call handling and voicemail).
International transfers
Some of these providers store or access data outside the UK, including in the European Economic Area and the United States. Where they do, transfers rely on UK adequacy regulations (including the UK Extension to the EU-US Data Privacy Framework where the provider is certified) or on the UK International Data Transfer Agreement or Addendum.
Retention
- Enquiries are kept for as long as needed to manage conflicts, normally six years.
- Instruction files are kept for at least six years after the instruction ends, or fifteen years where the engagement is under deed, in line with professional indemnity requirements, and are then securely destroyed.
- Professional contact details are reviewed at least every two years and deleted if no longer relevant, or straight away if you ask us not to contact you. The suppression list keeps only the minimum needed to respect your request.
- Accounting records are kept for six years after the end of the financial year to which they relate.
Security
We use access-controlled Microsoft 365 accounts with multi-factor authentication, encrypted connections, and restricted sharing of instruction files. Access is limited to those who need it for the work.
Your rights
Under the UK GDPR you have the right to be informed about how we use your information; to access it; to have it corrected; to have it erased or its use restricted in some circumstances; to data portability where processing is based on consent or contract and carried out by automated means; to object to processing based on legitimate interests; and to object at any time to direct marketing. Where we rely on consent you may withdraw it at any time. To exercise any right, contact enquiries@bakeraccordia.co.uk. We will respond within one month, which may be extended where the law allows. Some rights are limited where information is held for legal claims or is subject to legal professional privilege or a duty of confidence to a court or tribunal.
Complaints
If you are unhappy with how we have handled your information, please tell us first at enquiries@bakeraccordia.co.uk or by post at the registered office. We will acknowledge your complaint within 30 days, look into it, and tell you the outcome without undue delay. You also have the right to complain to the Information Commissioner's Office at ico.org.uk/make-a-complaint or on 0303 123 1113.
Cookies, analytics and fonts
This website sets no cookies and uses no advertising or tracking scripts.
To understand how the website is used, we use Cloudflare Web Analytics, a privacy-focused statistics service provided by Cloudflare, Inc. It does not use cookies or store anything on your device, does not fingerprint or identify individual visitors, and does not follow you across other websites. It records anonymous, aggregated information only: the pages viewed, the website that referred you, your country, and your device type and browser. Your IP address is used to deliver the request and is not stored for analytics. We use these statistics only to see which pages are useful and to improve the website. If you prefer not to be counted, you can block static.cloudflareinsights.com in your browser or with a content blocker, and the website will work as normal.
If you reach this website by clicking one of our Google adverts, Google adds a click reference to the web address. If you then send an enquiry, the website includes that reference with it. Nothing is stored on your device to do this. We use the reference only to tell Google Ads that an advert led to an enquiry, so we can see which adverts are worth paying for (our legitimate interest in managing our advertising). We do not send Google your name, contact details or the content of your enquiry.
Fonts are served from this website, not from a third party. Our emails do not contain tracking pixels.
